Kind of... They re-applied for the Trademark status so they are able to use the Descent name. As for the copyright, I believe that goes to the original creator. So that is the part others here have referred to as rights held by Mike and Matt.

I hope that they get the go-ahead for it, while aquiring the trademark status. We'll just have to watch and wait.

My personal opinion is that they're essentially squatting the rights in the hopes that someone with enough combined interest and investment dollars will buy it from them so they can go off and resurrect Descent in a new shop.

there certainly has been a dearth of good flight games in the midst of so many generic 3rd person shooters....a descent title now would do very well just because of it's uniqueness

Actually, IIRC, one of the WiiWare European launch titles was a flight game.

Not that it was particularly good though...
